I do not support the dotxxx TLD. While it has the potential to legitimize the industry, there are too many land mines…both legislative and competitive. I’m also concerned that its governance lacks suitable industry representation.
My answers below are based on a broader context, because the dotxxx TLD issue is only an indicator of the larger problem our industry faces.
Do you believe the First Amendment’s protective power will continue to extend to pornography?
Yes.
Why?
The question is to what extent. With two new conservative Supreme Court Justices in the wings, we are most likely in for 40 years of narrow latitude. Only time will reveal how much protection our form of speech will be afforded.
If you do not advocate a continuing reliance on the First Amendment, what alternative method or strategy do you propose for achieving protection from legal encroachments of Free Speech rights?
We certainly cannot afford to rely exclusively on First Amendment protection. It is a tool, not a solution.
If you step back and look at the laws governing pornography, particularly obscenity, they are an at will tool of the government. By that I mean authorities are not compelled to act.
This industry needs to place more attention on removing the incentive for attack than on neutralizing the weapons of our aggressors.
If you were the Emperor of the Adult Industry (meaning you have the power to establish absolute policy and to ban for non-compliance) what would be your most immediate actions?
In direct response to the question I would eliminate the cowboy element of this industry. It is this element that draws fire on us, and they need to go. Easier said than done.
While this element is not limited to the affiliates, it is certainly dominated by them. I fully expect this industry to roll up. If for no other reason, the government will force it. In doing so, the affiliate model will be discarded for more traditional marketing strategies, or perhaps new innovations in marketing afforded by the technology and medium we work in.
As Emperor of the Adult Industry I would quickly work myself out of the job by establishing a powerful industry association. This association might encompass the mainstream entertainment industry, as those lines are starting to get blurred.
We are our own worst enemy. We work in isolation but act as if there is solidarity. We are not organized and we are not disciplined. We have no self-imposed standards of conduct, opening the door for others to impose their standards on us. Like the Wild West, this town is in kayos, because it has not elected an honest and considerate sheriff.
