Jason Hendeles talks .XXX with DOTXXXBLOG
Jason Hendeles is Vice President of Strategic Business Development for the ICM Registry, sponsors of the .XXX Top Level Domain.
Last week, at a meeting of its Board, ICANN approved the .CAT sTLD for the Catalan language.
During the same meeting, .XXX was, for the second time, denied the green light.
Opponents of the .XXX TLD, as well as supporters, are encourged by the decision to defer. Detractors of the plan see the delay as a sign that a bad idea is in trouble. Supporters see ICANN’s reluctance as a sign of careful deliberation and a prelude to ultimate approval.
At the heart of the matter is the question: Does the “separation” of Pornography from the rest of the Web protect it or establish an irreversible vulnerability to outright censorship?
For its thematic magnitude, as bellwether of National Posture and direction, the .XXX debate has received national attention, and the decision, once made, will be discussed for years.
Unperturbed by last week’s deferment, Jason Hendeles shared some of his thoughts on the subject of .XXX.
In a statement released by ICANN about the decision, ICANN requested further contractual negotiations with ICM…
FROM ICANN STATEMENT: “The board directed ICANN staff to negotiate additional contractual provisions requiring development and implementation of policies consistent with ICM Registry’s application, The Board will consider the outcome of these negotiations at some future date.”
ICM’s apparent response to this from September 16th is posted on their rather spartan Web site and reads:
“We understand that the ICANN Board had specific questions about provisions to prevent scenarios whereby there could be significant changes in ownership and changes in the definition of the sTLD community, and that they asked the staff to consider whether contract changes were needed. We are encouraged by the Board’s focus on the contract, and quite confident that their questions can be fully and easily resolved. We look forward to working with ICANN to do so immediately.

Jason Hendeles: The existence of online adult material cannot be ignored, and ICM Registry strongly believes that .xxx is a means for the online adult-entertainment industry to demonstrate publicly and proactively that they are acting responsibly by both clearly labeling their websites and working towards developing and adopting business practices, thereby providing consumers with greater security, while also preventing inadvertent exposure for those wishing to avoid it.
Jason Hendeles: We understand and respect the views of those who are concerned about pornography on the Internet. The .xxx domain will create a clearly labeled space for legal expression — nothing that is illegal now will become legal because it appears on a .xxx site. The legal adult entertainment that will be permitted in .xxx is protected by the US Constitution, as is its dissemination.

Jack Mardack: yeah, we read the news too, but what interests me is that you have the ability to communicate with and win trust from the "other side" — conservatives, christians, pick your noun — that is very USEFUL — but the question remains, what do you want for porn? is your ambition a quick "smash and grab" blood-letting from an industry that is courtroom-weary, insecure, and friendless? OR, do you think porn is GOOD?
